You, on behalf of yourself and your spouse, next of kin, personal representatives, heirs and beneficiaries, hereby agree to forever hold harmless, waive and fully release 1Life Fully Lived as well as its respective sponsors, endorsers, officers, directors, shareholders, members, managers, employees, contractors, affiliates, agents, and attorneys (each a “Released Party” and, collectively, the “Released Parties”) from and against any and all liability, losses, damages or claims whatsoever pertaining to your participation in the event or any related activities including, without limitation, bodily injury or death and whether or not caused by the negligence or other acts or omissions on the part of any of the Released Parties.
You are solely responsible for the cost of any medical treatment which may be deemed necessary in the event of any illness, accident or injury or medical emergency resulting from or in connection with your participation in the event or any related activities.
You hereby waive your and your insurers’ right to make a claim against any of the Released Parties based on payments by insurers to you or on your behalf for any reason. This means your insurers have no rights of subrogation against any of the Released Parties. Furthermore, you hereby voluntarily agree and covenant not to sue any Released Party and voluntarily waive the rights to pursue any lawsuits or other legal redress against the Released Parties.
You hereby agree to pay and reimburse the Released Parties for all costs, damages and expenses that the Released Parties’ suffer as a result of your failure to abide by the terms of this Agreement including, without limitation, all attorneys’ fees and other costs and expenses incurred by Released Parties in defending any action brought by or on behalf of any of the parties or in connection with the Released Parties’ enforcement of this Section.
By attending and participating in the event, you recognize and are aware that 1Life Fully Lived may photograph, videotape, audiotape, record, and/or otherwise capture you, your person, your image, your face, your name, your likeness, your appearance, your voice, and other personal characteristics of you on tape, videos, recordings, in photographs, and in other form of media, either physical or digital (the “Recordings”).
You hereby grant irrevocable and unlimited permission for 1Life Fully Lived and its as its designated sponsors, endorsers, and affiliates to, in their sole discretion, use and publicly display, publicly perform and show, exhibit, transmit, broadcast, reproduce, record, photograph, digitize, modify, alter, edit, adopt, create derivative works, exploit, sell, rent license, and/or otherwise use the Recordings as well as testimonials or other statements that you provide and all materials created by or on behalf of 1Life Fully Lived (collectively, the “Materials) on a perpetual basis throughout the World.
You acknowledge that you will not receive any form of compensation from 1Life Fully Lived , relating to the publication, distribution or other use of the Recordings or Materials. 1Life Fully Lived shall own, and you hereby assign to 1Life Fully Lived , your entire right, title, and interest, if any, in and to the Recordings and Materials and all copyrights in the Recordings and Materials.
You acknowledge and agree that you have no right to review or approve the Recordings and Materials before they are used. You hereby irrevocably waive all legal and equitable rights under this Agreement and the use of the Recordings and Materials.
